Terms of Service

These Terms of Service ("Terms") govern your access to and use of ratingwall.com and the RatingWall service (the "Service"), operated by Hara Infotech Pvt Ltd ("RatingWall," "we," "us"), based in India. By creating an account or using the Service, you agree to these Terms. If you're using the Service on behalf of a business, you're agreeing on that business's behalf and confirming you have authority to do so.

1. The Service

RatingWall lets businesses collect customer testimonials over WhatsApp (as text, voice, or video), have them automatically transcribed and translated, moderate them, and publish approved testimonials to an embeddable "Wall of Love." Some features — including WhatsApp broadcast campaigns, custom domains, and AI transcription/translation — depend on plan tier and available credits.

2. Accounts

You must provide accurate information when creating an account and keep your login credentials confidential. You're responsible for all activity under your account, including actions taken by team members you invite. Notify us immediately at cs@ratingwall.com if you suspect unauthorized access.

3. Your responsibilities as a tenant

If you use RatingWall to contact your customers, you're responsible for:

• Having a lawful basis and, where required, obtaining consent before sending testimonial requests or campaign messages to a phone number over WhatsApp.
• Honoring opt-outs (STOP/UNSUBSCRIBE) — the Service enforces this automatically, but you may not attempt to circumvent it.
• Only requesting testimonials from real customers about genuine experiences with your business.
• Complying with the WhatsApp Business Platform's own policies, and all applicable laws (including anti-spam and data protection laws) in the jurisdictions where your customers are located.
• The accuracy and legality of any content you publish on your Wall of Love, including testimonials you've edited or translated.

We may suspend or terminate accounts that we reasonably believe are being used to send unsolicited messages, harvest data, or otherwise abuse the Service.

4. Testimonial content and licenses

Testimonials remain the property of the customers who submit them and the tenant who collects them. By submitting a testimonial through RatingWall, the submitting customer grants the collecting tenant, and the collecting tenant grants RatingWall, a non-exclusive, worldwide license to host, transcribe, translate, display, and distribute that testimonial as part of operating the Service (including on the tenant's Wall of Love and, where the tenant enables it, RatingWall's own marketing examples). Tenants are responsible for ensuring they have the right to grant this license for testimonials they collect.

5. Plans, billing, and credits

• Paid plans are billed on a recurring basis (monthly or yearly, as selected) through our payment processor, Razorpay.
• Plan limits (testimonials per month, walls, seats, AI credits) are described on our Pricing page and apply as stated there at the time of billing.
• AI credits (used for transcription and translation) reset monthly and don't roll over unless stated otherwise; unused credits have no cash value.
• "Founder pricing," where offered, is locked to your account for as long as your subscription remains active and unbroken; cancelling and re-subscribing later is not guaranteed to retain founder pricing.
• You can cancel a paid plan at any time from your dashboard; cancellation takes effect at the end of the current billing period, and we don't provide partial-period refunds except where required by law.
• Fees are exclusive of applicable taxes, which will be added where required.

6. Custom domains

Where available on your plan, you may connect a custom domain to your Wall of Love. You're responsible for maintaining ownership and correct DNS configuration of any domain you connect; we're not liable for issues arising from your domain registrar or DNS provider.

7. Acceptable use

You agree not to use the Service to: violate any law; infringe anyone's intellectual property or privacy rights; upload malicious code; attempt to gain unauthorized access to the Service or other accounts; scrape or resell the Service without our written permission; or send messages to people who haven't consented to receive them.

8. Intellectual property

RatingWall and its logos, branding, and software are owned by Hara Infotech Pvt Ltd. These Terms don't grant you any rights to our trademarks or branding except as needed to use the Service as intended (e.g. displaying the RatingWall badge on your Wall of Love, where applicable to your plan).

9. Third-party services

The Service relies on third-party providers, including the WhatsApp Business Platform (Meta), our transcription/translation provider, Razorpay, and Cloudflare. We're not responsible for outages, changes, or policy decisions made by these providers that affect the Service, though we'll make reasonable efforts to keep things running and let you know about material disruptions.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that transcription or translation output will be error-free, or that the Service will be uninterrupted or secure.

11. Limitation of liability

To the maximum extent permitted by law, RatingWall and Hara Infotech Pvt Ltd won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you materially breach these Terms, misuse the Service, or fail to pay applicable fees, with notice where reasonably practicable. On termination, your right to use the Service ends, though certain provisions (billing, IP, disclaimers, liability limits) survive.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you directly. Continuing to use the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the courts of India.
